ORDER granting in part and denying in part [32] Letter Motion for Extension of Time. That request is GRANTED IN PART. Accordingly: 1. The TRO entered at ECF No. 23 is EXTENDED on consent as to Li and East Pet through August 24, 2026. See Fed. R. Civ. P. 65(b)(2). This extension does not affect any other Defendant. 2. The Court shall hold a preliminary injunction hearing as to Li and East Pet on August 24, 2026, at 3:00 p.m. The hearing may be accessed by dialing +1 (646) 453-4442 and using access code 964 340 343#. 3. By August 17, 2026, Li and East Pet may file their response. By August 20, 2026, Plaintiffs shall file their reply, if any. Additionally: 1. If Plaintiffs wish for the Court to enter a preliminary injunction upon or prior to expiration of the TRO, Plaintiffs shall submit a proposed order by 5:00 p.m. on July 31, 2026; 2. By that same date, Plaintiffs shall serve Defendants a copy of this order; 3. By that same date, Plaintiffs shall submit proof of service of the summons, complaint, TRO, the Court's July 16 order at ECF No. 28, and this order, on Defendants. Such proof of service shall be accomplished via affidavit, not via letter, in compliance with Rule 4(l) of the Federal Rules of Civil Procedure. 4. By that same date, Plaintiffs shall address whether this Court has authority to enter a preliminary injunction against Defendants for whom Plaintiffs have "failed" to accomplish service. See ECF No. 29. Such letter shall also address what alternative relief, if any, Plaintiffs intend to request from the Court concerning such Defendants. Defendants and members of the public may attend the August 3, 2026, preliminary injunction hearing by dialing +1 (646) 453-4442 and using access code 761 323 657#. The Court will transmit a link for the hearing to the parties, including any Defendants who appear in this case or otherwise contact the Court, prior to the hearing. SO ORDERED. ORDER granting in part and denying in part [27] Letter Motion for Extension of Time. The Court further ordered that any opposition papers shall be served and filed by July 15, 2026, and that the parties should appear at the July 20, 2026, hearing to show cause why a preliminary injunction should not issue. Id. at 11. By letter dated July 16, 2026, Plaintiff has moved or an extension of the TRO through August 5, 2026, as well as an adjournment of the hearing currently scheduled for July 20, 2026. See ECF No. 27. It is further ORDERED that: 1. By July 27, 2026, Plaintiffs shall file a status update describing the compliance or noncompliance of Defendants and third parties with the Court's order, as well as Plaintiffs' efforts to serve Defendants. 2. The hearing scheduled for July 20, 2026, at 2:00 p.m. is ADJOURNED to August 3, 2026, at 2:00 p.m. By July 29, 2026, Defendants shall file any opposing papers. By July 30, 2026, Plaintiffs shall file a reply, if any. 3. Pursuant to Federal Rule of Civil Procedure 65(b)(2), the TRO is extended to August 3, 2026. Good cause exists for an extension, because adjourning the preliminary injunction hearing is necessary to ensure Defendants are afforded adequate notice, and continued restraint of Defendants and third parties in the interim period is necessary to protect Plaintiff's rights against the irreparable harms demonstrated in their TRO application. 4. By July 23, 2026, Plaintiff shall serve this order on Defendants using the same methods authorized by the TRO. By July 27, 2026, Plaintiff shall provide the Court with proof of such service. The Clerk of Court is respectfully directed to terminate the motion at ECF No. 27, which is GRANTED IN PART. SO ORDERED. Show Cause Response due by 8/3/2026. ORDER: To protect the public health, while promoting the "just, speedy, and inexpensive determination of every action and proceeding," Fed. R. Civ. P. 1, it is ORDERED pursuant to Rules 30(b)(3) and 30(b)(4) of the Federal Rules of Civil Procedure that all depositions in this action may be taken via telephone, videoconference, or other remote means. It is further ORDERED pursuant to Rule 30(b)(5) that a deposition will be deemed to have taken place "before an officer appointed or designated under Rule 28" if such officer attends the deposition using the same remote means used to connect all other participants, so long as all participants (including the officer) can clearly hear and be heard by all other participants.
