ORDER TO SHOW CAUSE FOR PRELIMINARY INJUNCTION AND TEMPORARY RESTRAINING ORDER: The Court has considered Plaintiff's ex parte application (the "Application"), including the declaration submitted in support of the Application, as well as all other papers filed in support of the Application, for the following relief: As further set forth herein. Based on the foregoing findings of fact and conclusions of law, Plaintiff's Application is hereby GRANTED and it is ORDERED as follows: As further set forth herein. Rule 4(f) of the Federal Rules of Civil procedure and Articles 1 and 15 of the Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters (the "Hague Convention") Pursuant to Article 15 of the Hague Convention, this electronic service is authorized for the purposes of the TRO and any Preliminary Injunction only. 7. The Clerk of Court is directed to issue a single original summons directed to all Defendants as listed in Schedule A To The Complaint that shall apply to all Defendants. 8. Plaintiff shall deposit with the Court Twenty-Five Thousand Dollars ($25,000.00)* either cash, cashier's check or surety bond, as security, which amount was determined adequate for the payment of such damages as any person may be entitled to recover as a result of a wrongful restraint hereunder. Plaintiff shall file a letter regarding the continuing need for sealing when (1) there is no longer a need to keep the matter under seal or (2) within fourteen days, whichever is earlier. This Temporary Restraining Order without notice is entered at June 9, 2026, twenty-eight (28) days from the date of this order, and for any further period as may be provided by Order of this Court* The Court finds, pursuant to Rule 65(b)(2) of the Federal Rules of Civil Procedure, that good cause exists to extend this temporary restraining order because, in the Court's experience, service in this type of case is complex and unlikely to be effectuated within fourteen days. The Clerk of Court is directed to terminate ECF No. 8. ORDER TO SHOW CAUSE RE PRELIMINARY INJUNCTION: Defendants are hereby ORDERED to show cause before this Court in a teleconference on July 6, 2026 at 4:00 p.m., why a preliminary injunction, pursuant to Fed. R. Civ. P. 65(a), should not issue. The conference will be held remotely by telephone in accordance with Rule 3.B of the Court's Individual Rules and Practices in Civil Cases, available at https://nysd.uscourts.gov/hon-jesse-m-furman. The parties should join the conference by calling the Court's dedicated conference line at (855) 244-8681 and using access code 2303 019 3884, followed by the pound (#) key. When prompted for an attendee ID number, press the pound (#) key again. Counsel should review and comply with the rules regarding teleconferences in the Court's Individual Rules and Practices in Civil Cases, including Rule 3(B)(i), which requires the parties, no later than 24 hours before the conference, to send a joint email to the Court with the names and honorifics (e.g., Mr., Ms., Dr., etc.) of counsel who may speak during the teleconference and the telephone numbers from which counsel expect to join the call. It is further ORDERED that opposing papers, if any, shall be filed electronically with the Court on or before June 29, 2026. By the same date, Plaintiff shall file a proposed preliminary injunction. Plaintiff shall file any reply in support of the preliminary injunction no later than July 2, 2026. IT IS FURTHER ORDERED that Defendants are hereby given notice that failure to appear at the show cause hearing scheduled above may result in the imposition of a preliminary injunction against them pursuant to Fed. R. Civ. P. 65, which may take effect immediately upon the expiration of this Order, and may extend throughout the length of the litigation under the same terms and conditions set forth in this Order.
