MINUTE entry before the Honorable Thomas M. Durkin: Plaintiff's motions for expedited discovery and electronic service of process [11] [12] are denied without prejudice. Plaintiff initially filed a complaint alleging infringement of a trademark in connection with the sale of its furniture products. Plaintiff then filed a notice of correction and filed a nearly identical complaint alleging infringement of a trademark in connection with the sale of its bedding products. Plaintiff's email submission of a proposed order references a plaintiff name other than the name in this case caption. In light of these discrepancies, Plaintiff's motions are denied. If Plaintiff intends to renew the motions, the Court will require the submission of screenshots of the allegedly infringing listings, clarification of the sales platform of Plaintiff's listings depicted at Exhibit 2 to the amended complaint, and an explanation of why expedited discovery of defendants' financial account information is necessary. Additionally, Plaintiff's counsel should review the recently issued opinion in Kangol LLC v. Hangzhou Chuanyue Silk Import & Export Co., Ltd., Case No. 25-2205 (7th Cir. May 29, 2026) regarding electronic service of process in Schedule A cases. Mailed notice.
